1. Agreement to Terms
By accessing or using The Working Hub ('the App', 'our App', or 'the Service'), you agree to be bound by these Terms of Service ('Terms'). If you do not agree to these Terms, you may not access or use the Service.
These Terms apply to all users of the App, including but not limited to business owners, managers, and employees.
2. Description of Service
The Working Hub is a workforce management platform that provides:
- Employee scheduling and shift management
- Time tracking and timesheet generation
- Team communication and messaging
- Time-off request management
- Location-based attendance verification
- Task and to-do list management
- Business analytics and reporting
We reserve the right to modify, suspend, or discontinue any aspect of the Service at any time.
3. Account Registration and Access
To use the Service, you must:
- Be at least 16 years of age
- Provide accurate and complete registration information
- Maintain the security of your account credentials
- Accept responsibility for all activities under your account
Business owners who create accounts agree to:
- Obtain necessary consents from employees for data collection
- Comply with all applicable labour and employment laws
- Use the Service only for legitimate business purposes
- Maintain appropriate licences required in their jurisdiction
Employees invited to join a business agree to:
- Provide accurate information about their employment
- Use the App for work-related purposes only
- Follow their employer's policies regarding app usage
- Respect the confidentiality of business information
4. User Responsibilities and Conduct
You agree not to:
- Use the Service for any illegal purpose or violate any laws
- Impersonate any person or entity
- Harass, abuse, or harm other users
- Upload viruses, malware, or malicious code
- Attempt to gain unauthorised access to the Service
- Scrape, copy, or reverse engineer the App
- Use the Service to spam or send unsolicited messages
- Interfere with the proper functioning of the Service
All content you create or share through the App must:
- Be accurate and truthful
- Not infringe on intellectual property rights
- Not contain offensive, discriminatory, or inappropriate material
- Comply with your employer's workplace policies
5. Data Ownership and Licensing
You retain ownership of all data you input into the Service, including schedules, messages, and employee information. By using the Service, you grant us a limited licence to:
- Store and process your data to provide the Service
- Create backups for disaster recovery
- Generate anonymised analytics to improve the Service
The Service, including its design, functionality, code, and content (excluding user data), is owned by The Working Hub and protected by intellectual property laws. You may not:
- Copy, modify, or create derivative works
- Sell, rent, lease, or sublicense the Service
- Remove or alter any proprietary notices
6. Location Tracking
The App offers optional location tracking features. By enabling location tracking:
- You consent to the collection of your precise location data
- Your location visits will be recorded and visible to authorised users
- Your employer may use this data for attendance verification
- You can disable location tracking at any time
Employers must obtain explicit consent before requiring location tracking as a condition of employment and must comply with all applicable labour laws.
7. Payment Terms
Some features of the Service may require a paid subscription. By subscribing, you agree to:
- Pay all fees associated with your chosen plan
- Provide accurate billing information
- Authorise automatic renewal unless cancelled
Subscription fees are non-refundable except as required by law or at our sole discretion. You may cancel your subscription at any time, but you will not receive a prorated refund for the remaining period.
We may offer a free trial period. At the end of the trial, your subscription will automatically convert to a paid plan unless you cancel before the trial expires.
8. Termination
You may terminate your account at any time through the App settings or by contacting support. Upon termination:
- Your access to the Service will be immediately revoked
- Your data will be retained for 90 days, then permanently deleted
- Certain data may be retained longer for legal compliance
We may suspend or terminate your account immediately if you:
- Violate these Terms
- Engage in fraudulent or illegal activity
- Fail to pay required fees
- Pose a security risk to the Service or other users
Upon termination, all rights and licences granted to you under these Terms will immediately cease. Provisions that by their nature should survive termination will continue to apply.
9. Disclaimers and Limitations of Liability
The Service is provided 'as is' and 'as available' without warranties of any kind, express or implied, including but not limited to:
- Warranties of merchantability or fitness for a particular purpose
- Warranties of non-infringement
- Warranties regarding accuracy, reliability, or availability
To the maximum extent permitted by law, we shall not be liable for:
- Any indirect, incidental, special, or consequential damages
- Loss of profits, revenue, data, or business opportunities
- Damages resulting from service interruptions or errors
- Damages caused by third parties or user conduct
Our total liability shall not exceed the amount you paid us in the 12 months preceding the claim.
We are not a party to the employment relationship between employers and employees. We are not responsible for:
- Compliance with labour laws, wage and hour regulations
- Workplace disputes or grievances
- Accuracy of timesheet data or payroll calculations
- Hiring, firing, or employment decisions
10. Indemnification
You agree to indemnify, defend, and hold harmless The Working Hub, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:
- Your use or misuse of the Service
- Your violation of these Terms
- Your violation of any rights of another person or entity
- Employment disputes or labour law violations
11. Dispute Resolution
Before filing a claim, you agree to attempt to resolve disputes informally by contacting us at legal@theworkinghub.com. We will attempt to resolve the dispute within 60 days.
Any disputes not resolved informally shall be resolved through binding arbitration in accordance with the rules of [Arbitration Organization]. You waive the right to participate in class actions or class arbitrations.
Either party may seek injunctive or other equitable relief in court to protect intellectual property rights.
12. Governing Law
These Terms shall be governed by and construed in accordance with the laws of Germany, without regard to conflict of law principles.
You consent to the exclusive jurisdiction of the courts located in Berlin, Germany, for any disputes not subject to arbitration.
13. Changes to Terms
We reserve the right to modify these Terms at any time. We will notify you of material changes by:
- Posting updated Terms on this page
- Updating the 'Last updated' date
- Sending an in-app notification or email
Your continued use of the Service after changes are posted constitutes acceptance of the modified Terms. If you do not agree to the changes, you must stop using the Service.
14. Severability
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue in full force and effect. The invalid provision will be modified to the minimum extent necessary to make it valid and enforceable.
15. Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and The Working Hub regarding the Service and supersede all prior agreements and understandings.

17. Export Compliance
You agree not to export or re-export the App or any technical data received from us in violation of applicable export control laws and regulations.
18. Force Majeure
We shall not be liable for any failure or delay in performance due to circumstances beyond our reasonable control, including acts of God, natural disasters, war, terrorism, pandemics, labour disputes, or government actions.
